By accessing this website or registering for any program offered by Golden Basketball Academy ("GBA"), you agree to these Terms. If you do not agree, do not use the site or our services.
2. Not Professional Advice
Content on this site is provided for general informational purposes only and does not constitute medical, athletic-training, legal, or academic advice. Always consult a qualified physician before your child begins any training program.
3. No Guarantees
Basketball development and academic outcomes depend on many factors beyond our control, including a player's effort, health, genetics, and opportunity. GBA makes no guarantee of athletic results, playing time, team selection, scholarship offers, college recruitment, or any specific outcome. Statements about past participants are illustrative and not a promise of future results.
4. Registration & Payment
Program fees, schedules, rosters, and locations are subject to change. Refund, cancellation, and make-up session policies are provided in your registration confirmation and are part of these Terms.
5. Assumption of Risk
Basketball involves inherent risks including, but not limited to, collisions, falls, sprains, fractures, concussions, and other physical injury. By enrolling, parents/guardians acknowledge and accept these risks. Additional release and waiver terms are provided in our Participant Waiver & Release, which is incorporated by reference.
6. Code of Conduct
Participants, parents, and guardians agree to treat staff, officials, venues, and other participants with respect. GBA may remove any person from a program for conduct that endangers safety, harassment, discrimination, or violations of facility rules, with no refund for dismissal due to misconduct.
7. Intellectual Property
All content on this site — including text, logos, photos, graphics, and course materials — is owned by GBA or its licensors and is protected by copyright and trademark law. You may not reproduce or redistribute it without written permission.
8. Third-Party Links
Our site may link to external sites. We do not control and are not responsible for their content or practices.
9. Disclaimer of Warranties
The website and services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, GBA and its owners, employees, contractors, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of this site or participation in our programs. Our total aggregate liability for any claim shall not exceed the amount you paid to GBA in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless GBA and its personnel from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your conduct, or your content submissions.
12. Governing Law & Venue
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-laws principles. Any dispute shall be resolved exclusively in the state or federal courts located in Multnomah County, Oregon, and the parties consent to personal jurisdiction there.
13. Arbitration & Class-Action Waiver
Except for small-claims matters and requests for injunctive relief, any controversy or claim arising out of these Terms shall be settled by binding arbitration in Multnomah County, Oregon under the Commercial Arbitration Rules of the American Arbitration Association. You and GBA waive any right to participate in a class or collective action.
14. Changes
We may update these Terms. Continued use of the site or programs after changes are posted constitutes acceptance.
