This page contains the plain-language version of the Assumption-of-Risk, Release, and Media provisions included in your signed enrollment forms. The signed form — not this page — is the operative legal document.
1. Assumption of Risk
I understand that participation in basketball training, team play, clinics, camps, travel, and related activities (collectively, "Activities") involves inherent and other risks of physical injury, including but not limited to: sprains, strains, fractures, dislocations, concussions and other head injuries, dental injury, cardiac events, heat-related illness, and — in rare cases — serious injury, permanent disability, or death. Risks also include contact with other participants, slips and falls on playing surfaces, equipment failure, transportation incidents, and exposure to illness. I voluntarily assume full responsibility for all such risks, whether known or unknown.
2. Release, Waiver & Covenant Not to Sue
In consideration of being permitted to participate, I, on behalf of myself, the participating minor, and our respective heirs, executors, administrators, and assigns, hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Golden Basketball Academy, its owners, directors, officers, employees, coaches, volunteers, contractors, host venues, and affiliates (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury — including death — that may be sustained in connection with the Activities, whether caused by the ordinary negligence of the Released Parties or otherwise, to the fullest extent permitted by Oregon law.
3. Indemnification
I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur as a result of my or my minor's participation in the Activities, including reasonable attorneys' fees.
4. Medical Authorization
I certify that the participant is in good physical condition and has no medical condition that would prevent safe participation. In the event of injury or illness during an Activity, I authorize GBA staff to administer basic first aid and, if necessary, to arrange for emergency medical treatment at my expense. I agree to provide current emergency-contact information and to disclose relevant medical conditions, allergies, and medications in writing prior to participation.
5. Concussion Acknowledgment
I acknowledge receipt of information about concussion signs, symptoms, and return-to-play requirements consistent with Oregon's youth-sports concussion laws. A participant suspected of sustaining a concussion will be removed from the Activity and will not be allowed to return until cleared in writing by a qualified health care provider.
6. Insurance
I understand that GBA does not provide primary medical insurance for participants. Any medical costs resulting from participation are my responsibility. I am encouraged to maintain personal health insurance covering the participant.
7. Photo, Video & Media Release
I grant GBA a royalty-free, worldwide, perpetual license to use photographs, video, and audio recordings of the participant taken during Activities for promotional, educational, and marketing purposes, including on social media and this website. No compensation will be paid. I may revoke this release prospectively by written notice to GBA; prior uses will not be retracted.
8. Code of Conduct & Dismissal
I agree that the participant, parents, and guardians will abide by GBA's Code of Conduct and facility rules. GBA may dismiss any participant for conduct that endangers safety or violates the Code, without refund.
9. Severability & Governing Law
If any provision of this waiver is held unenforceable, the remaining provisions shall remain in full force. This waiver is governed by the laws of the State of Oregon. Venue for any dispute shall lie exclusively in Multnomah County, Oregon.
10. Parent / Guardian Acknowledgment
I certify that I am the parent or legal guardian of the minor participant and that I have full authority to execute this waiver on the minor's behalf. I have read this document in its entirety, understand it, and sign it voluntarily.
